The third of the Faculty of Law Seminars series was held with Assist. Prof. Ahmet Dülger's presentation titled "Natural Powers of Arbitrators in International Arbitration" on Tuesday, November 14, 2023, at 15.30, in the meeting room of the Faculty of Law, located on the 7th floor of Block C.
Dr. Dülger stated that arbitration is not only a judicial activity as a dispute resolution method, but also a service that includes the authorization of the parties. In the seminar, it was explained with examples from arbitral and court decisions in Continental European and Anglo-Saxon legal systems that arbitrators, with their natural authority, ensure that a decision is made that is lawful and resolves the parties' dispute in all aspects.
Dr. Dülger also emphasized that arbitrators, who have natural powers, also have responsibilities such as not exceeding their authority and not acting contrary to public order, and the importance of making arbitral decisions within these limits.
The natural powers of the arbitrators were evaluated within the framework of the principles and practices in many fields of law, including administration, commerce, constitution, maritime and civil, with the questions, answers and comments of the participants.
