The “Conference on Additional Damages in the Context of Fundamental Rights and Freedoms” was held in Ankara on April 8, 2025, through the collaboration of the Constitutional Court of Turkey and the Court of Cassation.
Organized within the scope of the “Project on Supporting the Effective Implementation of the the Turkish Constitutional Court’s Judgments in the Field of Fundamental Rights” conducted by the Constitutional Court and the Council of Europe, the workshop brought together the President of the Constitutional Court, Kadir Özkaya, and the President of the Court of Cassation, Ömer Kerkez, as well as Vice Presidents and members of the Constitutional Court, the President of the Court of Cassation’s General Assembly of Civil Chambers, presidents and members of the Civil Chambers of the Court of Cassation, our Dean Prof. Dr. Özcan Günergök, and scholars from various fields. The opening speeches of the workshop were delivered by the Vice President of the Constitutional Court, Hasan Tahsin Gökcan, and the President of the General Assembly of Civil Chambers of the Court of Cassation, Adem Albayrak.
In his speech, Vice President Hasan Tahsin Gökcan emphasized that how additional damages are addressed in the Constitutional Court’s individual application rulings and in the jurisprudence of the Court of Cassation is highly significant for the justice-oriented development of the legal system. He expressed his belief that the conference, jointly organized with the Court of Cassation, would contribute to the development of a shared legal language and harmonization of jurisprudence by tackling not only the theoretical framework but also practical challenges, and he thanked all individuals and institutions who contributed to the organization of the event.
Adem Albayrak, President of the General Assembly of Civil Chambers of the Court of Cassation, also emphasized the importance of the workshop held in cooperation with the Constitutional Court and expressed gratitude to those who contributed to its organization. He highlighted the importance of the concept of additional damages in ensuring full justice, particularly in compensation law and judicial processes involving violations of fundamental rights and freedoms. Albayrak noted that the workshop would not only explore a legal concept, but also address issues related to fundamental rights and freedoms through the discussion of concrete cases.
Our Dean, Prof. Dr. Özcan Günergök, in his presentation, evaluated whether additional damages can be claimed in the context of currency devaluation, and offered solutions based on the decisions of the Court of Cassation and the Constitutional Court.
