The twelfth meeting of the Law Seminars organized by our Law School held at the meeting hall on 7th floor of Block C at North Campus, on April 30th, 2024.
In the seminar, Department of Criminal and Criminal Procedure Law Member Asst. Prof. Şölen Çakıroğlu started her presentation titled "Expectability in Criminal Law" by emphasizing the history, importance and place of the concept of expectability in criminal law. In order to determine the application area of the concept of expectability, firstly, the meanings attributed to the concept of expectability in the German doctrine under the doctrine of expectability and the criteria for limiting the concept were mentioned. Following the semantic analysis, the evaluations made within the framework of comparative law were applied to Turkish law and the place of expectability in Turkish criminal law was emphasized. After drawing attention to the importance of the effects of the expectability of lawful action on culpability and on excuses, the situations in which the concept is specific in negligence and delinquent crimes were discussed. In this context, the different handling of expectability in negligence crimes and delinquent crimes within the framework of the crime investigation method was evaluated. Following all these explanations, suggestions in regard to changes to the Turkish penal legislation on the concept of expectability were made.
